Permission has been granted by the Court of Appeal to challenge the outcome of the recent Country Guidance case on Sri Lanka, GJ and Others (post-civil war: returnees) Sri Lanka CG [2013] UKUT 00319 (IAC) (previous post: “New Sri Lankan Country Guidance“). The Dutch State is responsible for the death of three Muslim men from Srebrenica. This was the ruling given by the Dutch Supreme Court today. The men had sought refuge in the compound of the Dutch battalion (Dutchbat). Dutchbat decided not to evacuate them along with the battalion and instead sent them away from the compound on 13 July 1995. Outside the compound they were murdered by the Bosnian-Serb army or related paramilitary groups.
In two judgments the Supreme Court upheld earlier judgments of The Hague Court of Appeal of 2011 (ECLI:NL:GHSGR:2011:BR0132 and ECLI:NL:GHSGR:2011: BR0133) and 2012 (ECLI:NL:GHSGR:2012:BW9015 and ECLI:NL:GHSGR:2012: BW9014) and dismissed the State’s appeal in cassation against these judgments.
Background
Both cases concern events that took place shortly after the fall of the Srebrenica enclave on 11 July 1995. Hasan Nuhanović was in the employment of the United Nations. He worked as an interpreter at the compound in Potočari where Dutchbat was stationed. He had a UN pass and was on the list of local personnel who could be evacuated with Dutchbat. His father Ibro, mother Nasiha and brother Muhamed had sought refuge in the compound after the fall of the enclave. They were not on the list of local personnel and were informed on 13 July 1995 that they had to leave the compound. Shortly afterwards they were murdered by the Bosnian-Serb army or related paramilitary groups. Hasan is the plaintiff in one of these cases (and the respondent in the cassation proceedings).Rizo Mustafić was in the employment of the Srebrenica municipal authority and had been seconded by this authority to work for Dutchbat as an electrician at the compound. After the fall of the enclave Rizo, together with his wife and children, had sought refuge in the compound. The family was informed on 13 July 1995 that they had to leave the compound. Shortly afterwards Rizo was murdered by the Bosnian-Serb army or related paramilitary groups. His wife and children survived. They are the plaintiffs in the other case (and respondents in the cassation proceedings).
Two central questions
The proceedings before the Supreme Court turn on two questions:1. Can Dutchbat’s actions be attributed to the State?
2. Were Dutchbat’s actions wrongful?
Attribution?
The Supreme Court has answered the question of whether Dutchbat’s conduct can be attributed to the State by reference to public international law. In doing so it has followed two sets of rules drawn up by the International Law Commission of the United Nations.
The Supreme Court has held that public international law allows conduct to be attributed not only to the United Nations, which was in charge of the peace mission, but also to the State because the latter had effective control over the disputed conduct of Dutchbat. The Court of Appeal was therefore entitled to hold that Dutchbat’s conduct is attributable to the State.
Wrongful conduct?
The Court of Appeal held that Dutchbat’s conduct was wrongful under the law of Bosnia and Herzegovina, which is applicable in this case. This was challenged unsuccessfully in the cassation proceedings. The Supreme Court has added that judicial restraint in the review of Dutchbat’s conduct, as advocated by the State, would mean that there would be virtually no scope for the courts to assess the conduct of a troop contingent in the context of a peace mission. According to the Supreme Court, this is unacceptable. However, a court that assesses the conduct of a troop contingent in retrospect must make allowance for the fact the decisions in question were taken under great pressure in a war situation.

Edward Snowden is currently the most famous asylum seeker in the world after reportedly applying for refugee status in countries including Russia, Germany, Spain and Ecuador.
In many ways Snowden is far removed from the average asylum seeker. He is an American ex-spy, is assisted by WikiLeaks in his pursuit of asylum and was at one point believed to have been hiding in the Bolivian President’s plane. But the case of Edward Snowden means that people are reading about asylum, an issue that is shrouded by misconceptions. Tabloids and popular myths can make it appear as though western countries are perennially flooded by refugees. Opinion polling in 2012 showed that four out of 10 people in the UK believed that more than 10 per cent of the population are asylum seekers. The actual figure is less than 1 per cent.
Most asylum seekers are not American ex- spies who flee to Hong Kong en route to Moscow. Last year the largest number of any country came from war torn Afghanistan. Indeed the high correlation between countries that endure large scale violence (like Afghanistan and Iraq) or human rights abuses (China) and the number of people who flee them explains a lot. People are literally fleeing for their lives.

Is Edward Snowden a refugee? by Colin Yeo
Edward Snowden, the private contractor whoexposed the industrial scale intelligence gathering methods of the United States’ National Security Agency and our own GCHQ, is seeking asylum in Russia and a host of other countries. Hefears that his ‘freedom and safety’ are under threat. The US government asserts that he is a fugitive from justice, not a refugee.
Snowden is now at the mercy of high international politics. His case now transcends the law and a legal analysis is interesting on a hypothetical level but is probably largely pointless. Whatever the legal position, it seems likely that he will or will not be granted sanctuary according to political whims and convenience.
What is a refugee?
For what it is worth, Snowden almost certainly is a refugee as defined by the 1951 UN Convention Relating to the Status of Refugees, commonly referred to as the Refugee Convention. The definition (at Article 1(A)(2)) can be broken into its constituent parts:
If we go through these step by step, it is clear that he has a well founded fear of something happening to him if he goes back to the United States.
Whether that treatment would amount to persecution is a key question. Can criminal charges amount to ‘being persecuted’? If a murderer, say, escapes his home country and extradition back to his home country is sought, can he claim asylum on the basis that he will be imprisoned on return? No. Snowden has apparently broken US law, so why might his case be any different to a common criminal? In fact he still has a very strong case, as discussed below.
He does fall within the five Convention reasons (race, religion, nationality, membership of a particular social group or political opinion), that of political opinion. The US government might assert otherwise but it is crystal clear that his actions were politically motivated in exposing the truth about the system of government in the US and the extent of its control over its citizens. That falls squarely within the political opinion reason.
He is outside the US and will remain so while claiming asylum.
He certainly cannot secure the protection of his home state, the United States, which has rather rashly gone as far as withdrawing his passportand thereby arguably withdrawing consular protection.
Can criminal charges amount to ‘being persecuted’?
Yes, criminal charges can and sometimes do amount to persecution. Breaking a law then fleeing justice does not make one a refugee, but if the criminal offence or the criminal sanction do not meet internationally agreed norms as defined in the various international treaties, or if prosecution and/or punishment are discriminatory or disproportionate, then the individual is a refugee.
This has always been true under the Refugee Convention. The House of Lords examined this question in the case of Sepet and Bulbul [2003] UKHL 15, an asylum claim by two Turkish Kurds who did not want to perform military service in Turkey. Military Service was a requirement there and it was against the law to dodge the draft. International conventions do not prohibit compulsory military service and therefore the claimants could not show that their prosecution for draft evasion in Turkey would violate international norms.
The legal position within the European Union has been somewhat clarified and improved by the Common Asylum System, in particular the Qualification Directive 2004/83/EC. Article 10 of the Directive sets out a common EU understanding of what is meant by ‘acts of persecution’ and includes
“prosecution or punishment, which is disproportionate or discriminatory”

Snowden landed Sunday in Russia from Hong Kong, where the U.S. was seeking his extradition on espionage charges. Job description
SIM will be appointing three PhD researchers to engage in research on the so-called ‘receptor approach to human rights’. The receptor approach identifies the social institutions which are already in place in a given country to meet international human rights requirements, and it indicates how these institutions may be improved if they fall short of those requirements. By relying as much as possible on home-grown remedies, the receptor approach sets out to do justice to local culture and, at the same time, to enhance international human rights protection, especially in areas where such enhancement is most needed (see Tom Zwart, Using Local Culture to Further the Implementation of International Human Rights: The Receptor Approach, 34 (2012) Human Rights Quarterly, pp. 546-569). The project is being funded by the Dutch Foreign Office. The following topic will be researched:
The receptor approach and public international law
The PhD researcher covering this topic will look into the question if and how the receptor approach matches the requirements set by public international law regarding human rights. Thus, the receptor approach assumes that human rights may be implemented through non-legal means like culture and social institutions; that countries may retain their own – traditional – value system when they become signatories to human rights treaties; that the individual-versus-the-state paradigm is one but certainly not the only way to bring human rights to fruition; that the state can discharge its responsibility for implementing human rights obligations by leaving it mainly to non-state actors like the family and the community to realise human rights. The question is whether and how these elements of the receptor approach can be fitted into public international law regarding human rights.

The researchers for all three topics are expected to write a PhD thesis in a timely fashion under the supervision of the director of the Receptor Project, Prof. Tom Zwart; to participate in and contribute to the activities of the School; to enroll in the School’s PhD training program; and to prepare papers for submission to peer-reviewed journals. Approximately 80% of the time will be devoted to researching and writing the thesis, while 20% will be spent on other activities, including taking courses.

Conditions of employment
We offer a PhD position with a gross monthly salary starting at € 2,062 in the first year to € 2,638 in the fourth year of employment. The successful candidates will be offered an initial contract as a PhD student for 18 months. Upon positive evaluation of the PhD students’ performance the contract will be extended by 2,5 years. We offer a pension scheme, a holiday allowance of 8% per year and flexible employment conditions. Conditions are based on the Collective Employment Agreement of the Dutch Universities.
